CES LITIGES INCLUENT, SANS LIMITATION, LES LITIGES DÉCOULANT DE OU LIÉS À L’INTERPRÉTATION OU À L’APPLICATION DE CETTE CLAUSE D’ARBITRAGE, Y COMPRIS L’APPLICABILITÉ, LA RÉVOCABILITÉ OU LA VALIDITÉ DE LA CLAUSE D’ARBITRAGE OU DE TOUTE PARTIE DE CELLE-CI. TOUTES CES QUESTIONS SERONT TRANCHÉES PAR UN ARBITRE ET NON PAR UN TRIBUNAL OU PAR UN JUGE.

VOUS ACCEPTEZ QUE TOUT ARBITRAGE EN VERTU DES PRÉSENTES CGU SE FERA SUR UNE BASE INDIVIDUELLE ; LES ARBITRAGES COLLECTIFS ET LES RECOURS COLLECTIFS NE SONT PAS AUTORISÉS ET VOUS ACCEPTEZ DE RENONCER À LA POSSIBILITÉ DE PARTICIPER À UN RECOURS COLLECTIF, ET DE SERVIR EN TANT QUE REPRÉSENTANT, PROCUREUR GÉNÉRAL PRIVÉ, ET DANS TOUTE AUTRE CAPACITÉ DE REPRÉSENTATION, ET DE PARTICIPER EN TANT QUE MEMBRE D’UN GROUPE DE DEMANDEURS, DANS TOUT LITIGE SOUMIS À CETTE CONVENTION D’ARBITRAGE.

L’arbitrage sera administré par l’American Arbitration Association conformément à son règlement d’arbitrage de protection du consommateur, tel que modifié par les présentes CGU. L’arbitre tiendra des audiences, le cas échéant, par téléconférence ou vidéoconférence, plutôt que par comparution personnelle, à moins que l’arbitre ne détermine, à votre ou à notre demande, qu’une audience en personne est appropriée. Toute comparution en personne aura lieu dans un emplacement raisonnablement pratique pour les deux parties, en tenant compte de leur capacité à voyager et d’autres circonstances pertinentes. Si les parties ne parviennent pas à se mettre d’accord sur un emplacement, cette décision sera prise par l’AAA ou l’arbitre. La décision de l’arbitre devra être conforme aux conditions des présentes CGU et sera définitive et contraignante.
